It’s the second day of Senator Jeff Sessions’, R-Ala. (C, 78%) attorney general confirmation hearing, and the second day of leftists trying to paint Sessions as a racist.

During his questioning, Senator Ted Cruz, R-Texas (A, 97%) focused his attention on David Cole, a Georgetown Law professor and the national legal director for the American Civil Liberties Union (ACLU). In his opening statement to the Judiciary Committee, Cole blasted Sessions for investigating voter fraud in predominately black counties in Alabama while ignoring accusations of voter fraud in predominantly white counties while Sessions was a U.S. Attorney in Alabama in the 1980’s. (For more reading on the particulars of this case, check out this Conservative Review explanation of it.) Cole argued that “Sen. Sessions’ record on voting rights is deeply troubling.”

Senator Ted Cruz wasn’t having it.

He skewered Cole over the fact that in his testimony Cole omitted that the people who complained about voter fraud in the black counties that Sessions investigated were black:

“You blasted Senator Sessions for prosecuting civil rights leaders as a U.S. attorney in the 1980’s and insinuating that doing so made him a racist … You didn’t mention in your written or oral testimony that the complaints asking him to do so were brought forward by African American citizens who felt like their votes were being stolen,” said Cruz.

Cruz also noted that in his testimony, Cole “omitted that some ballots were tampered with” in the case that Sessions investigated. “Why did you omit the fact that the complaint came from African American citizens and black incumbent politicians?” Cruz asked Cole.

“I don’t think I intentionally omitted those facts,” answered Cole.

How convenient.

That Cole unintentionally omitted the facts that Sessions pursued the voter fraud case at the behest of blacks concerned about voter fraud occurring in their counties, and that the court did find that some of the ballots had been tampered with, strains credulity.

David Cole just got served.
