White House: No House vote? No impeachment cooperation

The following is an excerpt from Blaze Media’s daily Capitol Hill Brief email newsletter:

In its latest pushback against House Democrats’ impeachment efforts, the White House made the case that the lower chamber’s impeachment investigation is constitutionally illegitimate in an eight-page legal letter sent out late Tuesday afternoon.

The letter says that the executive branch doesn’t have to comply with the demands of Pelosi’s declared impeachment proceedings until the full House holds a vote on the matter. It also takes issue with the fact that committee ranking members haven’t been given subpoena power, as has been the “standard, bipartisan practice” in past proceedings.

"Given that your inquiry lacks any legitimate constitutional foundation, any pretense of fairness, or even the most elementary due process protections, the Executive Branch cannot be expected to participate in it," the White House counsel concludes.

Speaker Nancy Pelosi called the letter “manifestly wrong” and told the president he “will be held accountable.”

Top GOP lawmakers got behind the White House’s argument.

“The time for games is over,” said House Minority Whip Steve Scalise. “We won’t play by [Democrats’] fake rules.”

“Overturning the results of an American election requires the highest level of fairness and due process, as it strikes at the core of our democratic process,” said Senate Majority Leader Mitch McConnell. “So far, the House has fallen far short by failing to follow the same basic procedures that it has followed for every other President in our history.”
