Judge rejects Hunter Biden request to dismiss gun case, says it is not politically motivated



Hunter Biden's legal defense suffered a blow in court Friday after a federal judge in Delaware ruled that the federal gun case against the president's son would continue.

Biden is accused of lying about his drug abuse on a background check in Oct. 2018 when he applied for a gun permit. He is facing two counts of lying about drug abuse when seeking to buy a weapon and one charge of unlawful possession of a firearm while addicted to a controlled substance.

His attorneys argued that the case against Biden was politically motivated, but the judge presiding over the motion disagreed.

U.S. District Judge Maryellen Noreika said that Biden offered "nothing concrete" to prove that Republican efforts against him led to the charges he's facing.

“The pressure campaign from Congressional Republicans may have occurred around the time that Special Counsel decided to move forward with indictment instead of pretrial diversion, but the Court has been given nothing credible to suggest that the conduct of those lawmakers (or anyone else) had any impact on Special Counsel,” Noreika wrote. “It is all speculation.”

Biden's attorneys also argued that he had not committed a crime and that a first-time user would not have faced criminal charges.

Prosecutors argued that the evidence against Biden was "overwhelming" and included the discovery of cocaine residue in the pouch where he kept the gun.

Biden is also facing separate charges in California related to alleged tax evasion where he is accused of withholding $1.4 million that he owes to the government and for filing false tax returns. His attorneys had asked for those charges to be dismissed eight times, but the judge presiding in that case allowed it to continue.

The trial against Biden for the gun charge may be held in June, at a time when his father will be in the middle of a campaign to be re-elected.

Judge Noreika was appointed by former President Donald Trump in 2018 with Democratic support. She has not yet issued a judgement on Biden's defense that the charges are infringing on his Second Amendment rights.

Hunter Biden was recently spotted at the White House during the annual presidential Easter egg hunt.

Hunter Biden is in trouble — but not that much trouble apparently. Another case of nepotism will likely spare him from having to face any severe consequences.

“I don’t know a single lawful person that has a gun that is legal,” Beck says, “who doesn’t sweat going into another state, making sure beforehand [they are] legal.”

Except Hunter Biden.

The president’s son doesn’t have to sweat because his tax evasion and gun possession charges will likely be written off as misdemeanors, resulting in no jail time.

While President Biden was busy “making sure we don’t have guns,” Beck says, “his son lied on a document, signed his name to the document, saying, 'No I’m not a drug user.'" Now the fact that Hunter will likely receive minor consequences for a gun violation that would land most people behind bars has nothing to do with the president — or his connections, or his power, or the obvious nepotism at play. Couldn’t be.

The irony is glaring.

Biden “is all over wanting stricter restrictions on guns,” but when “his son violates a pretty basic one that is clearly marked out on paper where your signature is a felony — a felony to knowingly provide false information — he gets a misdemeanor,” Beck criticizes.

Hunter Biden has “committed crime after crime after crime ... and yet none of this is going to affect him at all,” Burguiere agrees.

“Madness,” Beck calls it, but he “[doesn’t] think the Hunter Biden story is done by any stretch of the imagination.”

Joe Biden responds to report Hunter Biden could be charged with gun and tax crimes: 'He's on the straight and narrow.'



Democratic President Joe Biden responded to a report that federal agents believed they had collected enough evidence to charge his son Hunter Biden with gun and tax crimes.

Biden was asked by CNN's Jake Tapper about the report on his show Tuesday.

"Our reporting, CNN's reporting and the Washington Post reporting suggests that prosecutors think they could, they have enough to, charge your son Hunter for tax crimes and a false statement about a gun purchase. Personally and politically, how do you react to that?" Tapper asked the president.

"Well, first of all, I'm proud of my son," responded Biden.

"This is a kid who got – not a kid, he’s a grown man – he got hooked on, like many families have had happen, hooked on drugs. He’s overcome that. He’s established a new life,” he added.

“I’m confident that he is – what he says and does are consistent with what happens. And for example, he wrote a book about his problems and was straightforward about it. I’m proud of him," Biden continued.

"He came along and said, by the way, this thing about a gun – I didn’t know anything about it. But turns out that when he made application to purchase a gun, what happened was he – I guess you get asked – I don’t guess, you get asked a question, 'are you on drugs, or do use drugs?’ He said no. And he wrote about saying no in his book,” he added.

“So, I have great confidence in my son,” Biden concluded. “I love him and he’s on the straight and narrow, and he has been for a couple years now. And I’m just so proud of him.”

Hunter Biden announced publicly that his taxes were under federal investigation in December 2020 where he asserted that he expected to be found innocent of any wrongdoing. He did not address the possibility of gun charges at that time.

The decision on whether Hunter Biden will face charges is up to Delaware U.S. Attorney David Weiss. He is expected to announce that decision after the 2020 midterm elections in November.
