Will Kamala Harris invoke the 25th Amendment against Biden? Senator weighs in

Many people, including Democrats, see Biden’s rapidly deteriorating mental state as a reason to invoke the 25th Amendment, which would transfer presidential powers to Kamala Harris.

Unfortunately, Harris is unlikely to be a better leader than Biden.

“[Kamala] would at least be alert,” says Glenn Beck, but “I don't know if she'd be any better.”

Even though Harris is “mentally competent,” she’s “a nightmare and a total idealogue who’s not all that bright,” says Senator Eric Schmitt (R-Mo.) in agreement.

The question everyone is asking is: Will she use the 25th Amendment against Biden? As long as she has the majority support of the Cabinet and two-thirds of the House and the Senate approve it, Harris has the power to dethrone Biden and likely end his 2024 presidential campaign.

Biden also has the power to invoke the 25th Amendment himself, but “that’s not going to happen,” Sen. Schmitt assures, adding that Biden “is not willingly giving this up.”

Even though Biden clearly refuses to acknowledge the “precipitous decline in his capabilities,” the rest of the country can see the plain truth.

“In interviews related to the document case, [Biden] couldn't remember when he was vice president,” Sen. Schmitt tells Glenn. “People see this playing out every day as he struggles to get through sentences, walking from place to place, falling.”

“Do you hear senators talk about this on the other side and say, ‘This is dangerous’?” asks Glenn.

“They, in private moments, will tell you that this is not the same Joe Biden,” confirms Sen. Schmitt. “People get it, people see it – people who serve with him, people who’ve been in the Oval Office talking to him see it.”

Whether or not Kamala Harris will cite the 25th Amendment as evidence to transfer Biden’s powers to herself remains to be seen, along with who the 2024 Democratic presidential candidate will be.

Rumors continue to circulate that Michelle Obama will take Biden’s place at the last minute.

To hear Sen. Scmitt’s thoughts on a third Obama term, watch the clip below.

Former impeachment champion Joe Biden calls GOP efforts to hold Mayorkas accountable 'unconstitutional'

House Republicans successfully impeached Department of Homeland Security Secretary Alejandro Mayorkas Tuesday night, leaving it to the U.S. Senate to decide his ultimate fate.

While historically a champion of impeachment when a Republican is in the crosshairs, President Joe Biden lashed out at those seeking to hold Mayorkas responsible for overseeing the illegal entry of several million foreign nationals into the nation. Like the DHS, Biden called the vote to impeach his DHS secretary "unconstitutional."

The vote and the articles of impeachment

Without the help of Republican Reps. Ken Buck (Colo.), Mike Gallagher (Wis.), and Tom McClintock (Calif.), the House GOP managed to pass a resolution to impeach Mayorkas in a 214-213 vote Tuesday evening.

The first article of impeachment accuses the Biden Cabinet secretary of a willful and systematic refusal to comply with the law.

Mayorkas allegedly violated "his oath to support and defend the Constitution of the United States against all enemies, foreign and domestic, to bear true faith and allegiance to the same, and to well and faithfully discharge the duties of his office," according to the article.

The second article accuses the DHS secretary of knowingly making false statements and obstructing lawful oversight of the DHS.

U.S. Customs and Border Protection figures indicate that in Mayorkas' first nine months as DHS secretary, 1,516,650 illegal aliens stole across the southern border and into the United States — nearly quadruple the number of migrants who entered throughout the entirety of the previous fiscal year. Roughly 6 million more have entered the country in the years since.

The Democratic-controlled Senate will almost certainly refuse to charge Mayorkas, rendering the House vote largely symbolic.

Rep. Mark Green (R-Tenn.), chairman of the House Committee on Homeland Security, stressed that his committee's "investigation and subsequent impeachment proceedings demonstrated beyond any doubt that Secretary Mayorkas has willfully and systematically refused to comply with the laws of the United States and breached the public trust."

"With this vote, Congress has made clear that we will not tolerate such lawlessness," added Green.

House Speaker Mike Johnson (R-La.) said, "Secretary Mayorkas has willfully and consistently refused to comply with federal immigration laws, fueling the worst border catastrophe in American history."

"Alejandro Mayorkas deserves to be impeached, and Congress has a constitutional obligation to do so," continued Johnson.

Biden lashes out

Biden was less than pleased over Republicans' successful vote to impeach Mayorkas.

"History will not look kindly on House Republicans for their blatant act of unconstitutional partisanship that has targeted an honorable public servant in order to play petty political games," Biden is credited as saying in a lengthy statement.

Although quick to invoke history in the abstract and to paint the impeachment initiative as petty, Biden previously championed impeachment when it meant the possible removal of a Republican from office.

Biden and other Democrats sought to impeach Trump over a phone call he had with Ukrainian President Volodymyr Zelenskyy concerning possible corruption on the part of the Biden family.

Biden even incorporated such demands for Trump's impeachment into his presidential campaign.

Time reported that while campaigning in 2019, then-candidate Biden told a small audience in Rochester, N.H., "Donald Trump has violated his oath of office, betrayed this nation, and committed impeachable acts. You know, to preserve our Constitution, our democracy, our basic integrity, he should be impeached."

In his Tuesday statement, Biden further claimed Mayorkas "has upheld the rule of law faithfully and has demonstrated a deep commitment to the values that make our nation great."

"Instead of staging political stunts like this, Republicans with genuine concerns about the border should want Congress to deliver more border resources and stronger border security," continued Biden. "Sadly, the same Republicans pushing this baseless impeachment are rejecting bipartisan plans Secretary Mayorkas and others in my administration have worked hard on to strengthen border security at this very moment."

Contrary to the president's suggestion, in recent weeks and months, Mayorkas and other elements of the Biden administration have fought not against illegal immigration but against Texas' efforts to secure the southern border. Just last month, the DHS threatened Texas after the Lone Star State seized control of a high-traffic area along the border in Eagle Pass.

A Jan. 14 letter from DHS General Counsel Jonathan Meyer instructed Texas to "remove all barriers to access to the U.S.-Mexico border."

Extra to casting Mayorkas as a man traduced, Biden accused Republicans of "playing politics with the border."

DHS echoes Biden

The DHS regurgitated the Democratic president's talking points in its response to the impeachment vote, noting, "House Republicans will be remembered by history for trampling on the Constitution for political gain rather than working to solve the serious challenges at the border."

"Without a shred of evidence or legitimate Constitutional grounds, and despite bipartisan opposition, House Republicans have falsely smeared a dedicated public servant who has spent more than 20 years enforcing our laws and serving our country," said DHS spokesman Mia Ehrenberg.

Ehrenberg further alleged that Mayrokas "will continue working every day to keep Americans safe."

Congressional investigators behind the impeachment push suggested in recent reports that Mayorkas' "open-border policies" and the illegal immigration they have ostensibly guaranteed not only impose an annual net burden of hundreds of billions of dollars every year on the U.S. economy but also exacerbate the fentanyl crisis, adversely impact public safety, contribute to a rise in human trafficking and exploitation of minors, and jeopardize public health.

The GOP is USELESS: Republicans FAIL to impeach Mayorkas

As the United States continues to be invaded through its southern border, Homeland Security Secretary Alejandro Mayorkas has continued to downplay and allow it.

The danger this spells out for the country has by and far made Mayorkas the most impeachable man in recent history.

And yet, the GOP has failed to do so.

Mayorkas barely survived an impeachment vote on Tuesday in the House after several Republicans helped stop the GOP-led attack on him.

The vote to impeach the secretary over his handling of the southern border was 214 in favor to 216 opposed.

Glenn Beck and Pat Gray are disappointed, to say the least.

“They’re useless, they’re worthless, and rarely, rarely do they pull anything off that we want them to or expect them to,” Gray tells Glenn.

Four Republicans joined the Democrats to vote against impeaching Mayorkas.

“He’s been telling us there’s no crisis, no invasion,” Glenn says. “10 million illegal immigrants have entered the U.S., doubling the existing population, and the Republicans couldn’t get that done.”

“The one thing you can say about the Democrats is no matter how radical, they all move together. They’re moving together to destroy the country, and we can’t get enough Republicans to stand together to save the Constitution,” he continues. “It’s infuriating.”

Homeland Security Committee sends Mayorkas impeachment vote to House floor: 'Hold this man accountable'

The House Homeland Security Committee approved two articles of impeachment against Homeland Security Secretary Alejandro Mayorkas early Wednesday morning, sending them to the House floor for a historic vote.

"I urge my colleagues on both sides of the aisle to do the right thing, put aside the politics, and agree that before we can fix Secretary Mayorkas' mess, Congress must finally hold this man accountable," Homeland Security Chairman Mark Green (Tenn.) said in a statement.

Although the Democrat-controlled Senate will likely spare Mayorkas from an ouster, an impeachment trial could nevertheless prove impactful ahead of the 2024 election.

The articles

The first article of impeachment accuses DHS Secretary Alejandro Mayorkas of a willful and systemic refusal to comply with the law.

Mayorkas allegedly violated "his oath to support and defend the Constitution of the United States against all enemies, foreign and domestic, to bear true faith and allegiance to the same, and to well and faithfully discharge the duties of his office," according to the article.

The first article further claims that Mayorkas "willfully and systemically refused to comply with the immigration laws, failed to control the border to the detriment of national security, compromised public safety, and violated the rule of law and separation of powers in the Constitution, to the manifest injury of the people of the United States."

The second article accuses Mayorkas of knowingly making false statements and obstructing lawful oversight of the DHS.

In addition to falsely claiming that U.S. Border Patrol agents maliciously whipped illegal aliens and that apprehended illegal aliens were being quickly removed, Mayorkas is also accused of making false statements to Congress concerning the "scope and adequacy of the vetting of the thousands of Afghans who were airlifted to the United States."

The impeachment proceedings came after a five-phase investigation and 10 subcommittee hearings examining Mayorka's role in the crisis at the southern border.

"The facts are indisputable," said Chairman Green. "For three years, Secretary Mayorkas has willfully and systemically refused to comply with the laws enacted by Congress, and he has breached the public trust. His actions created this unprecedented crisis, turning every state into a border state."

According to U.S. Customs and Border Protection, 988,819 illegal aliens stole into the nation under Mayorkas' watch between October and December 2023. 2.47 million illegal aliens entered the U.S. in fiscal year 2023; 2.37 million in FY 2022; and 1.73 million in FY 2021. Over 60% of those crossing the border illegally in fiscal years 2021-2023 were single adults.

Blaze News previously reported that a coalition of former FBI officials warned Congress last week that the border crisis was ushering in a "new and imminent danger" from "military-aged men from across the globe," which could result in a catastrophic attack on American soil.

"As a result, thousands of Americans have lost their lives and our nation is experiencing a historic national security, public safety, and humanitarian catastrophe," continued Chairman Green. "Make no mistake, Secretary Mayorkas' lawlessness is exactly what the Framers of our Constitution designed impeachment to remedy."

To the floor

Mayorkas defended himself in a last-minute Tuesday letter to the House Homeland Security Committee, reported Axios.

"I assure you that your false accusations do not rattle me and do not divert me from the law enforcement and broader public service mission to which I have devoted most of my career and to which I remain devoted," wrote Mayorkas. "I will defer a discussion of the Constitutionality of your current effort to the many respected scholars and experts across the political spectrum who already have opined that it is contrary to law."

Chairman Green said in response, "Secretary Mayorkas' 11th-hour response to the Committee is inadequate and unbecoming of a Cabinet secretary. ... A letter at 4:48am on the morning of our markup, repeating the same false claims and doubling down on his commitment to his continued lawless conduct, indicates the contempt with which he views Congress, the American people, and the Constitution he swore an oath to defend."

The committee deliberated for over 10 hours Tuesday, then passed the articles of impeachment early Wednesday morning in an 18-15 party-line vote.

— (@)

"Today is a grave day. We have not approached this day or this process lightly. Secretary Mayorkas' actions have forced our hand," Chairman Greensaid in his opening statements, reported Axios.

If the House floor vote is ultimately successful, Mayorkas would be the first Cabinet secretary impeached in nearly 150 years. President Ulysses Grant's secretary of war, William Belknap, resigned just ahead of his impeachment in 1876, reported ABC News.

Ranking Member Bennie Thompson (D-Miss.), previously the chair of the Jan. 6 committee, claimed that the "impeachment scheme is a dangerous attempt to distort the Constitution and the secretary's record to cover up [Republicans'] inability and unwillingness to work with Democrats."

Thompson added that "it's not in the best interests of this government," but rather an attempt to placate "some of the most extreme elements in the Republican Party."

Rep. Marjorie Taylor Greene (R-Ga.) tweeted after the vote, "Secretary Mayorkas has broken federal law and is the one to blame for all the horror, crime, death, murder, rape, and over 1.8 million known gotaways. But Democrats say this impeachment proceeding is over policy differences. Is this the immigration policy of the Democrats?"

Arizona Rep. Eli Crane joined other Republicans in stressing that "willingly exposing Americans to unnecessary threats through an open border deserves immediate removal. Let's get it done."

Rep. Andy Biggs (R-Ariz.), who filed impeachment articles against Mayorkas over two years ago, suggested that today is Mayorkas' "day of reckoning."

The New York Times indicated that the charges are likely to fail in the Democrat-controlled Senate, where a two-thirds majority would be necessary to both convict and oust Mayorkas; however, it's not all for naught.

The liberal paper conceded that it would "force and election-year trial that would fuel what promises to be a charged political debate" over the border crisis overseen by the Biden administration.

House Republicans unveil articles of impeachment against Homeland Security Secretary Alejandro Mayorkas: 'Threatens our national security'

House Republicans unveiled articles of impeachment against Homeland Security Secretary Alejandro Mayorkas on Sunday morning.

"Alejandro N. Mayorkas, in violation of his oath to support and defend the Constitution of the United States against all enemies, foreign and domestic, to bear true faith and allegiance to the same, and to well and faithfully discharge the duties of his office, has willfully and systemically refused to comply with Federal immigration laws," the impeachment articles read.

The GOP representatives declared Mayorkas had "repeatedly violated laws enacted by Congress regarding immigration and border security."

"In large part because of his unlawful conduct, millions of aliens have illegally entered the United States on an annual basis with many unlawfully remaining in the United States," the document continued. "His refusal to obey the law is not only an offense against the separation of powers in the Constitution of the United States, it also threatens our national security and has had a dire impact on communities across the country."

The articles of impeachment warned about the illegal entry of non-citizens on the terrorist watchlist invading the country.

Between the fiscal years 2017 through 2020, there were a combined 11 individuals on the terrorist watchlist caught attempting to cross the U.S. southern border. However, there were an alarming 169 non-citizens on the terrorist watchlist trying to enter the country in fiscal year 2023. So far in 2024, there have been 49 possible terrorists nabbed at the border.

Last week, a coalition of former FBI officials warned Congress that the border crisis is ushering in a "new and imminent danger" from "military-aged men from across the globe" infiltrating the southern border, which could result in a catastrophic attack on U.S. soil.

The impeachment articles stated, "Despite clear evidence that his willful and systemic refusal to comply with the law has significantly contributed to unprecedented levels of illegal entrants, the increased control of the Southwest border by drug cartels, and the imposition of enormous costs on States and localities affected by the influx of aliens, Alejandro N. Mayorkas has continued in his refusal to comply with the law, and thereby acted to the grave detriment of the interests of the United States."

The GOP lawmakers proclaimed that Mayorkas "implemented a catch and release scheme, whereby such aliens are unlawfully released, even without effective mechanisms to ensure appearances before the immigration courts for removal proceedings or to ensure removal in the case of aliens ordered removed."

The Republican reps wrote that there were an average of 590,000 illegal immigrants encountered at ports of entry on the Southwest border during the fiscal years of 2017 through 2020. During Mayorkas' tenure, the numbers skyrocketed to more than 1,400,000 in fiscal year 2021, over 2,300,000 in fiscal year 2022, and a whopping 2,400,000 in fiscal year 2023.

The articles of impeachment said the massive influx of undocumented migrants has created a "fiscal and humanitarian crisis and dramatically degraded the quality of life" for Americans.

The GOP politicians pointed out that New York City had already spent $1.45 billion addressing the migrant crisis, and would spend another $12 billion over the next three fiscal years – which has caused significant cuts to critical city services.

The impeachment articles highlighted that the "flow of fentanyl across the border and other dangerous drugs, both at and between ports of entry, has increased dramatically" with Mayorkas at the helm of the DHS.

The U.S. Customs and Border Protection seized approximately 4,800 pounds of fentanyl in fiscal year 2020, around 11,200 pounds in fiscal year 2021, an estimated 14,700 pounds in fiscal year 2022, and 27,000 pounds in fiscal year 2023.

More than 70,000 Americans died from fentanyl overdoses in 2022, and the lethal drug is the top killer of U.S. citizens between the ages of 18 and 45.

The articles of impeachment against Mayorkas were introduced by Rep. Mark Green (R-Tenn.).

Green declared, "These articles lay out a clear, compelling, and irrefutable case for Secretary Alejandro Mayorkas’ impeachment. He has willfully and systemically refused to comply with immigration laws enacted by Congress. He has breached the public trust by knowingly making false statements to Congress and the American people, and obstructing congressional oversight of his department."

The House Homeland Security Committee will consider the impeachment articles during a Tuesday morning meeting.

Speaker Mike Johnson (R-La.) has vowed to bring them to the House floor for a vote "as soon as possible."

The Department of Homeland Security responded to the allegations by saying in a statement that Republicans had failed to present evidence that Mayorkas had committed any "high crimes or misdemeanors."

"This markup is just more of the same political games from House Homeland Security Committee (CHS) Republicans," the DHS stated. "They don’t want to fix the problem; they want to campaign on it. That’s why they have undermined efforts to achieve bipartisan solutions and ignored the facts, legal scholars and experts, and even the Constitution itself in their quest to baselessly impeach Secretary Mayorkas."

House Democrat lectures mother of fentanyl overdose victim, but she exposes him with just one question: 'Have you?'

Rep. Dan Goldman (D-N.Y.) on Thursday lectured the mother of a fentanyl overdose victim. But unfortunately for Goldman, that mother was not interested in his political games.

At a House Homeland Security Committee hearing focused on the impeachment of Homeland Security Secretary Alejandro Mayorkas, Goldman challenged Josephine Dunn, an Arizona mother whose daughter died at 26 years old after mistakenly ingesting fentanyl.

At first, Goldman told Dunn she was being "used" by Republicans before belittling her knowledge and telling her she doesn't understand "what a high-crime misdemeanor is and how it relates" to impeachment proceedings. Then, he mocked Second Amendment supporters before finally asking Dunn if she agrees the U.S. needs more Border Patrol agents.

"I disagree with that because Border Patrol is now being used to make sandwiches and to screen people and let them into our country. So I disagree with you," Dunn responded.

Thinking he had caught her in a trap, Goldman responded, "So you don't think it would be helpful to have more Border Patrol officers who are charged with stopping the fentanyl trade?"

"I would like the Border Patrol to be able to do the job that they were hired to do. Every Border Patrol officer that I have spoken to has told me that their hands are tied by this administration and Mr. Mayorkas," she responded.

That's when Dunn turned the tables on Goldman and asked him a question — something the New York Democrat clearly did not like.

"I've been to the border, sir. Have you? Have you?" Dunn asked.

"I'm asking the questions," Goldman fired back.

Goldman then lectured Dunn again. He told her the "problem" with her response is that other Homeland Security officials have said the agency needs more personnel. He used the rest of his time to defend President Joe Biden and essentially blame Republicans for the border crisis.

As part of her testimony, Dunn told the committee that she believes Mayorkas is "partially responsible" for her daughter's death.

"In my humble opinion, Mr Mayorkas is partially responsible for my daughters death," she said. "His wide-open border policy allows massive quantities of poisonous fentanyl into our country.

"This is an invasion, a weapon of mass destruction, and unimaginable death and damage to our country and facilitated by Mr. Mayorkas. His participation in all of this [in] what I believe is a war is clearly intentional support of the enemy, which disqualifies him from his position. Our country deserves a secure border. We need to close the fentanyl super highway," she added.

DHS secretary confronted with impeachment news at the same time he blames Republicans for border crisis

Homeland Security Secretary Alejandro Mayorkas was confronted Wednesday about formal plans to impeach him just as he was blaming Republicans for the border crisis.

During an interview on MSNBC, Mayorkas was asked how the Biden administration will respond to Democratic mayors who are demanding the federal government step in and help them address migrant crises in their sanctuary cities. The secretary, however, responded by attacking Texas Gov. Greg Abbott (R).

"We have taken action on the border, and we’ve taken action with respect to the challenges that cities across the country are facing," Mayorkas said without naming a single "action."

"Let me let me identify one fundamental problem here," he continued, "and that is the fact that we have one governor in the state of Texas who is refusing to cooperate with other governors and other local officials and coordinate efforts to address a challenge that this country should stand united to address.

"And it's a remarkable failure of governance to refuse to cooperate with one’s fellow local and state officials," Mayorkas claimed.

But just as Mayorkas failed to provide a single example of the "action" the Biden administration has taken to stymie the border crisis, he didn't provide a single example of Abbott "refusing to cooperate" with other governors and federal officials to handle the border crisis.

Mayorkas went on to blame the Trump administration for the growing backlog of migrants who will wait years before their asylum cases are heard in an immigration court.

At the same time that Mayorkas was abdicating any responsibility for the border crisis, MSNBC host Willie Geist confronted Mayorkas with news that broke around the same time as the interview: the House Homeland Security Committee is moving forward with efforts to impeach Mayorkas for his role in the border crisis.

"I know you have to run, Mr. Secretary, quickly before you do. We’re just getting news this morning from Punchbowl News that the House Homeland Security Committee is formally moving ahead with impeachment proceedings against you with the first hearing to be held a week from today," Geist informed Mayorkas.

Mayorkas responded that he will cooperate with the inquiry. The first full committee hearing for the impeachment proceedings will take place next Wednesday, Jan. 10.
