Judge blocks Biden admin from ending Title 42 asylum rules



A Louisiana judge extended a preliminary injunction against the Biden administration ending Title 42 asylum rules put in place during the coronavirus pandemic by the former Trump administration.

Title 42 prevents asylum seekers from gaining entry into the United States to await their paperwork being processed by immigration officials. Illegal alien advocates accused the former administration of being motivated by racism, but advocates of Title 42 say it prevents infections of citizens by migrants.

On Friday, U.S. District Judge Robert Summerhays sided with the plaintiffs that ending the policy would result in “significant threat of injury” based on estimates that migrant crossings could increase by threefold.

“The record also includes evidence supporting the Plaintiff States’ position that such an increase in border crossings will increase their costs for healthcare reimbursements and education services,” wrote Summerhays in the ruling. “These costs are not recoverable.”

Title 42 has been in force since March 2020. 20 states have joined the lawsuit against ending the policy on the basis that a surge in migrants passing through the border would deleteriously affect social services. As many as 18,000 migrants could pass through the border by one reported estimate from the Department of Homeland Security.

DHS Secretary Alejandro Mayorkas told reporters that they expected a surge if Title 42 were ended but that it would eventually subside and plateau.

The Biden administration has tried to deflect criticism about ending Title 42 by passing the buck to the CDC and claiming that it's merely following the guidance set by health officials.

A poll in April found that ending Title 42 was the most unpopular policy endorsed by the Biden administration, with 55% either opposing or strongly opposing the policy while only 34% said they support the move.

Court temporarily blocks Biden admin from dropping Title 42 restrictions at the border



Missouri Attorney General Eric Schmitt said Monday that a court had issued a temporary restraining order against the Biden administration plan to end Title 42 restrictions at the border.

The policy had been previously scheduled to end on May 23.

"In a lawsuit originally filed by Missouri, Louisiana, and Arizona, our Office just obtained a temporary restraining order to keep Title 42 in place," tweeted Schmitt.

"This is a huge victory for border security, but the fight continues on," he added.

Title 42 prevents those seeking asylum at the border from entering the country to await their documents being processed. The policy was originally implemented under the Trump administration because of the threat posed by migrants carrying coronavirus into the country.

Critics of the policy claim it was motived by racism and xenophobia against migrants seeking refugee status.

The Centers for Disease Control announced that the drop in coronavirus cases and hospitalizations no longer necessitated the restrictions. The Biden administration has used the assessment by the CDC to justify ending Title 42 despite criticism that it will almost certainly lead to a massive spike in illegal immigration.

In Oct. 2021, Biden administration officials estimated that as many as 400,000 new migrants could attempt to cross the border in a month if Title 42 had been rescinded at that time.

The temporary restraining order prevents the Biden administration from acting before a May 13 hearing about the policy.

Arizona Attorney General Mark Brnovich also celebrated the order on Monday.

"I am so proud of the lawyers from our office who just got a Temporary Restraining Order to keep Title 42 in place," tweeted Brnovich. "We will continue to fight the Biden administration's open border policies."

'The View' hosts get into heated debate about Biden rescinding Title 42 policy on the border



Two co-hosts on "The View" got into a heated debate over whether the U.S. should be taking in all refugees possible after the Biden administration rescinds Title 42 restrictions on immigration.

The women were debating President Joe Biden's immigration policies with guest host Stephanie Grisham, the former White House press secretary for the Trump administration, when the discussion got very heated.

Grisham argued against "Open Borders" policies which angered Sunny Hostin who claimed that any exclusionary policies were motivated by racist discrimination.

"Under U.S. law, a refugee is a person who is unable to or unwilling to return to his home country because of various reasons. In this country, once you enter the country, you have a right, a legal right because of our Constitution, because of the strength of our laws to ask for asylum," Hostin said.

"And so when you say they come in illegally, I take umbrage to that, especially because 14,000 Haitians were expelled under the Biden administration. Especially because 76,000 Afghans were welcomed to this country, which they should have been," she added.

"So it seems to me, the law is OK for some people, but not for people who look like me!" Hostin concluded to applause from the audience. "And I don't like that!"

Sara Haines later chimed in to support Grisham's contention.

"When Vice President Harris went down there, she said these states right now were not equipped at the borders, and then we saw an influx, and we can't handle them, they couldn’t house them. Remember they were carrying food across the lakes," Haines said.

"The problem is right now, our boat is not at its strongest, the lifeboat is not at its strongest, we are dealing with the highest inflation in 40 years, we're in a war, we're trying to avoid a World War III," she continued.

"So we should just not follow the law?" Hostin interrupted.

"No it's not that, Sunny, but it's the same thing as if you have a lifeboat and you say, 'I want to save everyone,' and everyone gets on and the boat flips, you save no one," Haines responded.

"Right now, we're floundering, we have people that can't eat!" she added.

Haines went on to point out that even the Biden administration admitted that the growing crisis at the border was a worsening problem.

Whoopi Goldberg concluded the discussion by bringing up the Cubans, and Joy Behar added that Ukrainians are never accused of smuggling fentanyl into the country.

Also on Wednesday, a poll released by Morning Consult showed that rescinding Title 42 was among the most unpopular policies of the Biden administration.

Texas Gov. Greg Abbott says he's going to ship illegal aliens to DC and drop them off at the steps of the US Capitol



Fed up with illegal immigration in Texas, Gov. Greg Abbott (R) said Wednesday that he was going to have charter buses ship illegal aliens to Washington D.C. and drop them off at the steps of the U.S. Capitol.

Abbott made the comments at a media briefing announcing the steps his administration would take to respond to the Biden administration rescinding Title 42 and the expected massive wave of illegal immigrants.

"To help local officials whose communities are being overwhelmed by hordes of illegal immigrants who are being dropped off by the Biden administration, Texas is providing charter buses to send these illegal aliens who have been dropped off by the Biden administration to Washington, D.C.," said Abbott.

"We are sending them to the United States Capitol where the Biden Administration will be able to more immediately address the needs of the people that they’re allowing to come across our border," he added.

Abbott said he was ordering the Texas Division of Emergency Management to operate the project.

State officials said they were ready to activate up to 900 charter buses, according to Fox News reporter Bill Melugin.

Title 42 was a controversial policy put in place under the Trump administration in response to the threat of coronavirus infections among the illegal immigrant community. Experts worry that without the policy, hundreds of thousands of illegal immigrants and refugee applicants would flood over the U.S.-Mexico border.

Illegal immigration advocates immediately excoriated Abbott over his announcement.

"This is a sick and reprehensible stunt that will increase militarization and violence against people seeking asylum!" tweeted the official account for United We Dream. "We have the resources to welcome refugees + treat people with dignity, but Abbott is choosing to meet people with violence and his twisted attempt at humiliation."

Among those critical of the Biden administration over the rescission of Title 42 was Democrat Sen. Joe Manchin of West Virginia.

"Title 42 has been an essential tool in combatting the spread of COVID-19 and controlling the influx of migrants at our southern border. We are already facing an unprecedented increase in migrants this year, and that will only get worse if the Administration ends the Title 42 policy," said Manchin.

"We are nowhere near prepared to deal with that influx," he added.
