Here's why Trump is right NOT to send the NYC terrorist to Gitmo

President Trump is right to lean against sending Sayfullo Saipov, the New York City vehicle-ramming jihadist, to Guantanamo Bay.

On Thursday, the president expressed confidence in going through the federal judicial system as opposed to declaring the NYC terrorist an “enemy combatant” and opening him up to the military tribunal system in place at Gitmo.

Americans rightfully want to see to it that the man responsible for killing eight and injuring many more Tuesday afternoon in Manhattan faces maximum justice for his crimes. Given the broken military tribunal system for enemy detainees, they’ll find a much more efficient and effective system stateside.

In response to the Sept. 11 attacks, President George W. Bush established the detention center at the U.S. Guantanamo Bay Naval Base in Cuba for enemy combatants, who would be charged under the Department of Defense military tribunal commissions.

While Guantanamo has successfully removed jihadists from American prisons, where they could potentially recruit more radical Islamists for their cause, the legal system for prosecuting America’s enemies has failed to produce due process. The detention center has become a de facto indefinite holding jail where a trial never occurs.

Even though the liberal media may tell you otherwise, life at Guantanamo is paradise for detainees, compared to what prisoners face at a maximum security prison in the continental U.S.

And consider this: More than 16 years after al-Qaeda terrorists took down the Twin Towers, the worst terrorist attack in history on American soil, the suspected masterminds of the attack remain in a holding pattern, stuck in pre-trial proceedings at Guantanamo Bay’s war court.

The trial of the “9/11 Five” – Khalid Shaikh Mohammed (KSM), Walid Bin Attash, Ramzi Bin Al Shibh, Ali Abdul Aziz Ali, and Mustafa Al Hawsawi – has not started, and prosecutors have essentially given up on projecting a trial start date.

There are many reasons for why there have been so many hurdles in moving the 9/11 Five through legal proceedings. Much of the blame falls on the Bush- and Obama-era prosecution teams, while some can be attributed to intelligence missteps and bureaucratic hurdles.

Nonetheless, the 9/11 Five will not face justice anytime soon, and the American taxpayer is paying a fortune to continue the charade indefinitely.

But the 9/11 Five at least have been formally charged. Only two other jihadist comrades of theirs face formal charges. The other 35 detainees held at Guantanamo – some of whom were captured well over a decade ago – have not even been formally charged yet.

If the ISIS-inspired NYC terrorist is sent to Guantanamo, he may have a better chance of dying of old age before his sentencing. For those who want both a speedy trial and a hopeful death sentence, trying him under the non-combatant judicial system is the way to go.
