Ocasio-Cortez says Biden should simply ignore Texas judge's ruling on abortion pill, cites FDR as a precedent



Socialist Democrat Rep. Alexandria Ocasio-Cortez of New York reacted to a decision by a Texas judge against abortion pills by opining that President Joe Biden should ignore the ruling altogether.

Ocasio-Cortez made the comments in a rambling interview with Anderson Cooper on his CNN show Friday evening after Judge Matthew Kacsmaryk ruled that the FDA had incorrectly approved of an abortion pill more than two decades ago.

"Some of these rulings, I think we've been preparing and anticipating for their being these egregious overreaches, by members of the judiciary, appointed by a right-wing Republican party, uh, whose goal for a very long time was just to pack these courts with partisan judges, often, under-qualified, or completely unqualified for their role," she said.

"And so, there has been thought, I believe, given to this, Senator Ron Wyden (D-Ore.) has already issued statements, uh, for example, advising what we should do in a situation like this, which I concur," Ocasio-Cortez continued.

"Which is, I believe, that the Biden administration should ignore uh, this ruling," she stammered.

"I think that we should, you know, the courts have the legitimacy, and they rely on the legitimacy of their rulings," she explained, "and what they are currently doing is engaged in an unprecedented and dramatic erosion of the legitimacy of the courts."

Cooper pushed back on her demand by warning her that it would be unwise to set a precedent for the executive branch to simply ignore rulings by the judicial branch of the government. Ocasio-Cortez answered by claiming that many of the judges appointed by former President Donald Trump were unqualified for their role.

She went on to compare the abortion pill to Claritin, an antihistamine, or Aspirin, a pain medication, and cited a historical anomaly when President Franklin D. Roosevelt tried to ignore a ruling from the Supreme Court a hundred years ago. She did not mention that even Democrats excoriated Roosevelt for trying to upend government order, and he eventually acquiesced.

Ocasio-Cortez' comments are even more mystifying given that Kacsmaryk's ruling allows the government seven days to file an appeal and fight the ban from going to into place until a higher court can decide on the matter.

Breaking: Texas judge suspends FDA approval of the sale of abortion pill, gov't has seven days to seek legal relief



A Texas judge found that the Federal Drug Administration improperly approved the sale of an abortion pill and he has given the government seven days to seek legal relief.

The order is a blow to pro-abortion advocates.

Federal Judge Matthew Kacsmaryk issued a stay against the FDA's approval of mifepristone, but the government will be given a week to file an appeal to the Fifth Circuit Court.

The lawsuit was filed in November by a group arguing that the FDA had insufficient grounds to approve the use of the drug over two decades ago. Mifepristone is the most common form of abortion in the U.S., but providers have already switched to a different drug in anticipation that it might be banned.

If the case is appealed after the Fifth Circuit Court, it could be appealed to the U.S. Supreme Court.

Abortion advocates like the Guttmacher Institute excoriated the decision.

"An anti-abortion judge in Texas just ruled in the lawsuit challenging FDA approval of mifepristone. Our experts are reviewing the decision and will have more soon. This case is a frontal attack on a drug used in more than half of all US abortions," read a statement from the institute.

"Who should be in charge of whether you can access needed health care: an extremist MAGA judge, or your doctors and the FDA?" tweeted activist Laura Packard.

Democratic Sen. Elizabeth Warren of Massachusetts also criticized the decision in a string of tweets, noting angrily that the judge had been appointed by former President Donald Trump, a Republican.

"One Trump-appointed judge in Texas thinks he knows better than decades of scientific evidence and ruled to block access to medication abortion nationwide. Because of today’s lawless ruling, women could lose access to a safe and legal medication they’ve relied on for decades," she tweeted.
