Clarence Thomas Has No Reason To Recuse From Any J6 Cases And It’s Not Even Close
These attacks have nothing to do with ethics concerns and everything to do with shrinking the court to let leftist justices decide these cases.
Rep. Alexandria Ocasio-Cortez (D-N.Y.) smeared Supreme Court Justice Clarence Thomas and his wife on Monday to argue that Thomas should recuse himself from a forthcoming case involving Donald Trump.
Last week, the Supreme Court agreed to hear Trump's appeal of the Colorado Supreme Court ruling that he is constitutionally disqualified for the presidency. If Thomas rules in the case, Ocasio-Cortez argued on CNN that it would be a "scandal."
"I think it's very clear Clarence Thomas, and, rather, his wife, Ginni, participated in the events of Jan. 6," Ocasio-Cortez told CNN anchor Anderson Cooper without evidence.
"And now what is likely going before the Supreme Court is a judgment as to whether an event that his wife participated in, that his wife has been investigated by, in the Jan. 6 committee in, qualifies as an insurrection," she continued. "And Clarence Thomas' decision on that one way or another, and overall the court's decision on that, would directly implicate his wife.
"So this is just one of the most classic textbook conflicts of interest," she claimed, "and it would, frankly, be a scandal if he did not recuse himself."

Cooper did not push back on any of Ocasio-Cortez's misleading claims.
First, Ginni Thomas did not "participate" in Jan. 6, a reference in the American political vernacular to the riot at the U.S. Capitol on Jan. 6, 2021. She did, on the other hand, attend the pro-Trump rally that took place outside the Capitol hours before the violence broke out.
Second, Ginni Thomas has not been charged with insurrection — or any crime, for that matter. If she had committed any wrongdoing related to Jan. 6, as Ocasio-Cortez suggested, then the Justice Department certainly would have prosecuted her, as the DOJ is aggressively prosecuting anyone who broke a law on Capitol Hill that day.
Third, the Supreme Court is not going to decide whether Jan. 6 was an "insurrection." Rather, the question before the court is, according to Trump's petition for certiorari: "Did the Colorado Supreme Court err in ordering President Trump excluded from the 2024 presidential primary ballot?"
The truth is: There is no evidence of the "textbook conflicts of interest" that Ocasio-Cortez claims exist.
Instead, Democrats are engaging in an intimidation campaign to force Thomas to recuse himself based on the political views of his wife, a standard to which they hold no other leader. And if Thomas doesn't comply, Democrats will argue the court has been delegitimized, causing Americans to doubt the objectivity of the court, especially as it relates to novel cases involving Trump.
