Federal prosecutors seek retrial for former detective shot at by Breonna Taylor's boyfriend



The Biden Department of Justice failed to get a conviction last month in the federal civil rights case against the former Louisville detective who returned fire during a drug raid when shot at by Breonna Taylor's boyfriend.

Despite admitting ahead of the Nov. 17 mistrial that it would take "enormous resources ... to retry this case," federal prosecutors revealed this week they plan to refile charges against former Detective Brett Hankison.

What's the background?

Louisville Metro Police Department narcotics detectives attempted to execute a "no-knock" search warrant around 12:43 a.m. on March 13, 2020. The apparently falsified warrant pertained to a drug investigation involving 26-year-old Breonna Taylor's ex-boyfriend, Jamarcus Glover.

Police indicated they knocked repeatedly, announced their presence, then utilized a ram to gain entry. At the time, Taylor was inside the apartment with her then-boyfriend, Kenneth Walker, reported WHAS-TV.

When the police got the door open, Walker opened fire, striking Sgt. Jonathan Mattingly in the upper thigh and hitting his femoral artery. Officers returned fire.

In the exchange, Taylor was struck multiple times and killed. Mattingly survived, and Walker, initially charged with attempted murder of a police officer, later had his case dismissed.

Hankison reportedly fired 10 shots during the incident but did not hit Taylor or anyone else. He was nevertheless kicked off the force in June 2020 and ended up being the only officer criminally charged in the raid — with three counts of wanton endangerment.

The former detective was ultimately found not guilty of the wanton endangerment state charges last year.

Mistrial

Attorney General Merrick Garland — facing sustained pressure from Taylor's family and activists — announced charges for Hankison and the other officers involved in the fatal raid in August 2022.

Hankison was indicted accordingly for two civil rights offenses and accused of willfully using "unconstitutionally excessive force, while acting in his official capacity as an officer, when he fired his service weapon into Taylor’s apartment through a covered window and covered glass door."

The indictment noted that multiple bullets fired by the former detective traveled through the wall of Taylor's apartment and into neighboring apartments, endangering a pregnant woman, her partner, and their son.

During the trial, the former detective claimed his actions were the result of an attempt to defend himself and his fellow officers after seeing Mattingly catch a bullet from a shadowy figure who he figured was armed with a rifle, reported CNN.

"I felt helpless knowing that I had a handgun and I was facing rifle fire," Hankison testified. "Even though I had a tactical vest on, I knew that was no match for if the shooter came out with the rifle."

"I knew they were trying to get to him, and it appeared to me they were being executed with this rifle," continued Hankison. "I returned fire through the sliding glass door, and that did not stop the threat."

The Hill reported that after several days of deliberation in November, the 12-member jury notified U.S. District Judge Rebecca Grady Jennings that they were at an impasse. Jennings implored them to keep trying. While they obliged her, their continued efforts were in vain.

Learning that the jury was deadlocked on both counts against Hankison, Jennings declared a mistrial on Nov. 17.

"I think the totality of the circumstances may be beyond repair in this case," said Jennings. "They have a disagreement that they cannot get past."

As the 47-year-old former officer was not acquitted, he remained susceptible to a retrial.

Retrial

While federal prosecutor Michael Songer indicated a retrial will be costly, an attorney for the Taylor family told reporters last month, "The assistant U.S. attorneys from the Department of Justice did indicate that it is their intention to retry Brett Hankison in this case."

Sure enough, federal prosecutors informed Hankison during a status hearing Wednesday that they plan to refile charges, the former detective's attorneys, Stew Matthews and Ibrahim Farag, confirmed to CNN.

A status hearing is reportedly set for Jan. 24, and a trial date has tentatively been set for Oct. 14.

Jack Byrd, another attorney for Hankison, filed a new motion of acquittal over the weekend, noting, "The evidence presented by the government in this case is insufficient to sustain a conviction on any of the Counts."

A spokesperson for former President Donald Trump disclosed evidence on Monday allegedly corroborating Trump's claim that FBI agents seized his passports at Mar-a-Lago.

What is the background?

On Monday, Trump accused FBI agents of seizing his passports when they raided his residence at Mar-a-Lago last week.

"Wow! In the raid by the FBI of Mar-a-Lago, they stole my three Passports (one expired), along with everything else," Trump alleged. "This is an assault on a political opponent at a level never seen before in our Country. Third World!"

Hours later, CBS News anchor Norah O'Donnell reported, citing sources, that the FBI was not in possession of Trump's passports, which suggested that the FBI never seized them.

But what is the proof?

In response to O'Donnell's reporting, Trump spokesman Taylor Budowich shared an email sent earlier in the day from Jay Bratt, an official in the National Security Division of the Justice Department, confirming that the FBI had in fact confiscated Trump's passports and was in the process of returning them.

The email, which was sent to Trump attorneys Evan Corcoran and Jim Trusty, read:

We have learned that the filter agents seized three passports belonging to President Trump, two expired and one being his active diplomatic passport. We are returning them, and they will be ready for pickup at WFO at 2 pm today. I am traveling, but you can coordinate further with [redacted] copied above. Thanks.

The email also confirms a second point of O'Donnell's reporting, which said the DOJ is working to return any items seized from Mar-a-Lago that were not included in the search warrant.

Importantly, Bratt's email was sent before Trump's public accusations.

Anything else?

The DOJ is fighting to keep the affidavit used to obtain the search warrant, which contains the probable cause for the search, under government seal.

Trump, however, is pushing for the government to publicize the documents.

Shortly before 9 p.m., law enforcement declared the pro-abortion protest an unlawful assembly.

Department of Public Safety told AZ Family reporter Michael Raimondi, "Our troopers were in the Senate lobby in full view of the rioters as they pounded on the glass. We believe they had every intention of getting inside the senate building."

Arizona GOP state Senator Kelly Townsend said, "We are currently there being held hostage inside the Senate building due to members of the public trying to breach our security. Townsend later said, "Everyone is okay, and we are finishing our work."

Seth Dillon, CEO of the popular satire website the Babylon Bee, declared that he has a reached a deal with the woman behind the popular Libs of Tik Tok Twitter account "that will turn her heroic, high-risk work into a career."

He noted that the deal is not with the Babylon Bee, but that he "personally" made the deal with her.

Libs of Tik Tok shares videos of leftists openly exposing their radical attitudes and beliefs.

Dillon's declaration comes after Libs of Tik Tok has recently faced Twitter suspensions, and a Washington Post columnist Taylor Lorenz faces criticism for a piece that names and discusses a woman said to be behind the account.

Dillon declared on Twitter, "The exposure of @libsoftiktok isn't journalism; it's pure intimidation. They're threatened by her effectiveness, so they hope to silence her by making her too afraid to continue. They want to raise the cost of doing her work so high that she has no choice but to quit."

Washington Post reporter taken to the woodshed for doxxing anonymous Libs of TikTok creator, prompting outlet to stealth-edit the report



Social media came for Washington Post technology reporter Taylor Lorenz in full force after she was accused of doxxing the anonymous creator of the popular Twitter account Libs of TikTok.

The outlet then appears to have stealth-edited the report to remove the woman's personal information.

Lorenz made headlines earlier in April after bursting into tears during an MSNBC hit recounting online harassment to which she said she was subjected, which reportedly prompted her to contemplate suicide.

What are the details?

According to reports, Lorenz sparked fury after she doxxed the anonymous woman in a Tuesday report for the Post, sharing a link to the woman's real estate license, which showed her address.

A portion of the report accused the social media user of nefariously trying to shape right-wing media and thus public policy.

"Libs of TikTok reposts a steady stream of TikTok videos and social media posts, primarily from LGBTQ+ people, often including incendiary framing designed to generate outrage," the report said. "Videos shared from the account quickly find their way to the most influential names in right-wing media. The account has emerged as a powerful force on the Internet, shaping right-wing media, impacting anti-LGBTQ+ legislation and influencing millions by posting viral videos aimed at inciting outrage among the right."

"The anonymous account’s impact is deep and far-reaching," Lorenz warned. "Its content is amplified by high-profile media figures, politicians and right-wing influencers. Its tweets reach millions, with influence spreading far beyond its more than 648,000 Twitter followers. Libs of TikTok has become an agenda-setter in right-wing online discourse, and the content it surfaces shows a direct correlation with the recent push in legislation and rhetoric directly targeting the LGBTQ+ community."

On Monday, the Libs of TikTok account shared an image of Lorenz outside of a family's home. She captioned the photo, "Which of my relatives did you enjoy harassing the most at their homes yesterday?"

At the time of this reporting, the tweet has received more than 65,000 likes and has generated a firestorm of comments accusing Lorenz of hypocrisy.

Lorenz tweeted in her defense, writing, "Reporters make phone calls, send messages, show up places, and knock on doors when reporting out a story."

She aded, "I reported this story out extensively, using every tool I had, to ensure I had the correct woman."

She also insisted that the woman's identity should not necessarily remain private, because she "isn't just some average woman with a social media account" and is, instead, a "powerful influencer operating a massively impactful right wing media shaping discourse around LGBTQ+ rights."

The backlash

Thousands of comments castigating Lorenz for what they said was a hit piece on the Twitter user began flooding the site beginning Tuesday morning.

Pulitzer Prize-winning journalist Glenn Greenwald hit out at Lorenz after the Libs of TikTok photo went viral and tweeted, "The same people who — just 2 weeks ago — were insisting that criticizing Taylor Lorenz is wrong because it generates ‘harassment’ toward her are now cheering as she shows up at the homes of the relatives of Twitter users to dox them.”

Security guard, a former cop, shot and killed while protecting TV news crew during robbery; colleagues honor 'kind person with a heart of gold'



A former police officer turned security guard was gunned down while protecting a TV news crew in Oakland, California. Kevin Nishita succumbed to his gunshot injuries and passed away. A reward is being offered for information that leads to the arrest of the gunman.

On Nov. 24, a KRON-TV news team was covering the aftermath of a smash-and-grab robbery where 12 thieves raided a clothing store. At 12:20 p.m., an assailant allegedly attempted to steal KRON's camera equipment. Nishita — who was providing security for the TV news crew — attempted to protect the KRON employees, but a gunman shot the security guard.

Nishita was shot in the lower abdomen, and rushed to the Highland Hospital. He was in critical condition and needed emergency surgery. Sadly, Nishita passed away at 4:39 a.m. on Saturday.

An onlooker was hit by bullet shrapnel, according to the Oakland Police Department. He was taken to a hospital, and is listed in stable condition.

The Oakland Police Department released a photo of the suspect's vehicle: a 2004–2008 Acura TL, white, 4-door, with a sunroof and no front license plate.

A reward of $32,500 is being offered to anyone who provides information that leads to the arrest of the shooter. KRON and its parent company, Nexstar Media Inc.; Nishita's employer, Star Protection Agency; and the Oakland Police Department donated to the reward fund.

Investigators with Oakland Police Department's Homicide Section are asking anyone with information to contact them at (510) 238-3426.

Nishita leaves behind a wife, two children, and three grandchildren.

Prior to working as a security guard, Nishita served as a police officer at the Oakland Housing Authority, Hayward Police, San Jose Police, and the Colma Police departments.

Tributes poured in from police departments in the area.

The San Jose Police Department released a statement on the murder of one of their former officers.

It is with great sadness and broken hearts that we are sharing the news of the passing of former San José Police Officer Kevin Nishita #3740. On November 24, 2021, Kevin was working a security detail for a local news crew in the City of Oakland when he was shot during an attempted robbery. He was taken to a local hospital with a life-threatening injury, he remained in critical condition until today when he succumbed to his injury.
Kevin was employed by the City of San José as a Police Officer from 2001-2012. During his time with us he worked as a Gang Investigations detective as well as working our Gaming/Vice Unit. In addition to his Police assignments, Kevin also spent some time representing his peers as a director with the San José Police Officers Association. In 2012 he joined the Colma Police Department.

San José Chief of Police Anthony Mata said, "We are heartbroken and mourning the passing of retired Colma Police Department Sergeant Kevin Nishita. Kevin was part of our San José Police family for eleven years wearing the San José Police patch with great pride."

KRON employees reacted to the tragic shooting death by praising Nishita.
