Obama judge prevents Trump admin from eliminating 'flawed' Biden migrant parole program



A Massachusetts-based Obama judge blocked the Department of Homeland Security from ending the Biden administration's CHNV parole programs, which allowed multitudes of otherwise inadmissible migrants from Cuba, Haiti, Nicaragua, and Venezuela to flood into the country.

U.S. District Judge Indira Talwani also certified a class of all those foreign nationals who received a grant of parole affected by the DHS' termination of the program.

Talwani, a daughter of immigrants from India and Germany, claimed that the Trump administration "offered no substantial reason or public interest that justifies forcing individuals who were granted parole in the United States for a specific duration to leave (or move into undocumented status) in advance of the original date their parole was set to expire."

"Nor is it in the public interest to summarily declare that hundreds of thousands of individuals are no longer considered lawfully present in the country," continued Talwani. "The early termination, without any case-by-case justification, of legal status for noncitizens who have complied with DHS programs and entered the country lawfully undermines the rule of law."

Ironically, the Biden administration appears to have played fast and loose with the law when admitting migrants into the country under the CHNV parole program.

Background

The House Judiciary Committee noted in a November report, "Through CHNV, each month up to 30,000 aliens, who otherwise have no basis to enter the country and who have 'a supporter' in the United States, can bypass the U.S. border and fly directly into the country 'on commercial flights' to be 'granted parole' for a period of two years by the Secretary of the Department of Homeland Security."

While federal law requires that the DHS secretary use his parole authority on a "case-by-case basis for urgent humanitarian reasons or significant public benefit," former DHS Secretary Alejandro Mayorkas apparently figured it better to permit inadmissible aliens en masse — the consequences of which were felt across the country but especially in Springfield, Ohio, which was overwhelmed by Haitian nationals.

'This fundamentally flawed program must be permanently dismantled.'

According to the report, over 531,000 Cubans, Haitians, Nicaraguans, and Venezuelans had entered the country via the program as of September 2024.

Congressional investigators noted that in addition to the issue of the Biden administration flouting federal law, the program was "plagued by so much fraud that DHS itself was forced to pause the program in July 2024."

Blaze News previously reported that an internal probe found that over 100,000 applicants were backed by approximately 3,000 serial sponsors.

Sen. Ted Cruz (R-Texas), among the many Republican lawmakers who criticized the program, said in a Sept. 10 letter to Mayorkas, "This fundamentally flawed program must be permanently dismantled. The program has not only facilitated widespread fraud, but has also exposed serious vulnerabilities in our immigration system, leading to dire consequences for public safety."

Despite its awareness that foreign nationals were recycling Social Security numbers, addresses, and phone numbers in their applications, the Biden administration resumed the program the following month.

Eliminating the program

On his first day back in office, President Donald Trump signed an executive order directing DHS Secretary Kristi Noem to "terminate all categorical parole programs that are contrary to the policies of the United States established in my Executive Orders, including the program known as the 'Processes for Cubans, Haitians, Nicaraguans, and Venezuelans.'"

The Department of Homeland Security followed through, announcing last month in the Federal Register that it was terminating the CHNV parole programs on March 25.

'The [DHS] Secretary's discretion in this area is broad.'

Foreign nationals whose temporary parole period in the U.S. under the program had not already expired were notified that their paroles would terminate on April 24 "unless the Secretary makes an individual determination to the contrary."

The DHS noted further that parolees without a lawful basis to remain in the country had to leave the U.S. before their parole termination date. Those who remained unlawfully would be deported.

White House press secretary Karoline Leavitt noted, "These are the 530,000 illegal immigrants that Joe Biden flew to the United States on the taxpayers [sic] dime. They're welcome to self-deport using the newly repurposed CBP Home App!"

Lawsuit

Justice Action Center, Human Rights First, and Haitian Bridge Alliance sued on behalf of foreign nationals to prevent the Trump administration from ending the previous administration's parole processes. They found a fellow activist in Talwani.

The Obama judge acknowledged that her "role in reviewing agency action in this area is limited" and that "the [DHS] Secretary's discretion in this area is broad" but nevertheless made clear she would meddle anyway.

Talwani said that the migrants have standing to challenge the shortening of their grant of parole, noting that if their "parole status is allowed to lapse, Plaintiffs will be faced with two unfavorable options: continue following the law and leave the country on their own, or await removal proceedings."

The judge suggested that both options were undesirable.

Talwani noted that if required to depart the U.S., then migrants might undergo family separation, forfeit opportunities to obtain a remedy for their Administrative Procedure Act claims, and face dangers back in their respective homelands. If they remain in the country illegally, then they will lose their legal work authorization and possibly face arrest, wrote the judge.

To spare foreign nationals from an election-backed reversal of Democratic policy, Talwani ruled to temporarily preserve the legal status of CHNV migrants and block the DHS' enforcement on April 24.

"Hundreds of thousands of our neighbors will go to sleep tonight knowing that the Trump administration's attempts to delegitimize and criminalize our communities have been thwarted, for now," Guerline Jozef, founder of Haitian Bridge Alliance, said in a statement.

"The court rightly recognized the harm the government's arbitrary decision-making was threatening in the lives of innocent people," said Anwen Hughes, a legal strategist at Human Rights First.

Immigrant — just 13 years old — stabs man with help of 3 masked accomplices because victim wouldn't snap their photo: Report



A 13-year-old immigrant from Ecuador stabbed a man in New York City with help from three masked accomplices after the victim wouldn't photograph them, the New York Post reported, citing police and sources.

A young teenage male and his comrades approached the 23-year-old victim around 9 p.m. Sunday at West 40th Street and Seventh Avenue and asked him to take a photo of them, police and sources told the Post.

'We are seeing juveniles commit five, six, seven robberies.'

When the man declined, the 13-year-old and the other three ganged up on the man, punching him in the face and stabbing him in the back and leg with a brass-knuckle knife, the paper said, citing authorities.

Police added that they unsuccessfully tried to grab the victim's cellphone, the Post reported, adding that authorities and police said the victim refused medical attention as the stab wounds were superficial.

The suspects ran off, but officers managed to nab the male teen in question after searching the area with the victim, police added to the paper.

The Post said ViralNewsNYC first reported the incident. A pair of NYPD officers can be seen escorting a handcuffed young male into the Midtown Precinct South station in a video ViralNewsNYC posted to X.

The 13-year-old male was charged with second-degree robbery, police and sources told the paper.

The Post said his last known address is the Roosevelt Hotel, which has been converted into a immigrant shelter.

Guardian Angels founder Curtis Sliwa in September said illegals were flooding into the area "every day," according to the Post: "They're still checking in at the [city intake center at] the Roosevelt Hotel. And they have complete immunity. You arrest an illegal alien, they get cut loose."

The arrested teen was previously busted Oct. 26 in connection to a chain snatching on a northbound F train at McDonald Avenue and Avenue X in Brooklyn, law enforcement sources said. Four other suspects were involved — with all five holding down the victim, who had been sleeping before the robbery but then tried to fight off the muggers, the sources said.

The teen’s bust — just steps from the Crossroads of the World — came weeks after NYPD Chief of Crime Control Strategies Michael Lipetri told the Post the force is “arresting juveniles at the highest level than we have ever seen before.”

“We are seeing juveniles commit five, six, seven robberies," Lipetri said, according to the paper. "Most of them get dealt with under the Family Court statutes.”

Mother of Puerto Rican woman allegedly murdered by illegal alien endorses Trump: 'We have to stop this'



The Georgia Bureau of Investigation announced last week that they found the likely remains of 25-year-old Minelys Rodriguez-Ramirez of Cornelia. The man suspected of kidnapping and murdering the Puerto Rican native is an illegal alien, Angel DeJesus Rivera-Sanchez.

Keen to spare other families from similar heartbreak, Rodriguez-Ramirez's mother endorsed President Donald Trump at his Sunday rally in Macon, Georgia, emphasizing that it's high time to end this trend of illegally imported barbarism.

Rodriguez-Ramirez, the mother of a 9-year-old girl who had a popular TikTok account where she shared fitness routines, was engaged to be married. Julio Tovor, the victim's fiancé, told Now Hambersham, "Minelys talked about her daughter a lot. She treasured her daughter."

According to Tovor, his fiancée went to Walmart to exchange a photo with an acquaintance. Her car was later found pulled over on the side of Hazel Creek Road.

The victim's family reported her missing on Oct. 23, and six days later the GBI announced that her likely remains were found near the Walmart where she was last seen.

Rivera-Sanchez, 24, was arrested last week and charged with both kidnapping and murdering Rodriguez-Ramirez. Georgia state Sen. John Albers (R) indicated that the suspect was apprehended in Atlanta "as he tried to flee back to Mexico."

Habersham County Sheriff Joey Terrell confirmed to the Northeast Georgian that Rivera-Sanchez is an illegal alien and accused the Biden-Harris Department of Homeland Security of staying tight-lipped on the matter due to the election.

'I will not let them spill one more drop of precious American blood.'

"[Rodriguez-Ramirez] moved from Puerto Rico and secured employment with Mt. Vernon Hills, Inc. and tirelessly supported her daughter, mother and fiance. She did everything right, yet her life was cut short because of our federal government's repeated failure to protect its own citizens," Albers said in a statement. "Once again, our open-border policies have claimed another innocent life on American soil, right here in Georgia."

Albers asked, "How many more lives must be lost due to the open-border policies in Washington, D.C.?"

The victim's mother, Carmen Ramirez, took the stage at Trump's rally Sunday, holding a flag that read, "Don't blame us[.] We voted for Trump. The Milholen-Ramirez Fam."

After hugging the president, Ramirez introduced herself as the murdered woman's mother, indicating, "She was murdered last Tuesday. I lose my daughter, but I don't lose my faith."

"I know Donald Trump is the best choice for the U.S.A.," continued the bereaved mother. "He is the only one we need to save our country."

"I have a 25-year-old daughter with a lot of life, and somebody stopped her life. And we have to stop with this and keep going with Donald Trump," added Ramirez.

After Ramirez implored Trump to "make America great again," Trump discussed Democrats' border policies then played a video endorsement from another mother who lost her daughter allegedly as a result of illegal aliens.

Following a video endorsement from Alexis Nungaray, who underscored that her 12-year-old daughter, Jocelyn, would not have been allegedly raped and murdered by two illegal Venezuelan nationals had border czar Kamala Harris secured the border, Trump told Georgians Sunday, "The day I take the oath of office, the migrant invasion ends and the restoration of our country begins."

"When you vote on Tuesday, remember this: Kamala is importing illegal alien rapists and murderers; draconian monsters who are killing our children, our brothers, our sisters, our parents, our friends. They're willing to kill anyone," said Trump. "When I win I will not let these animals into our country any longer. I will not let them spill one more drop of precious American blood."

Another illegal alien has been charged with raping a minor just months after Jen Psaki laughed off Virginians' concerns



Former Biden press secretary Jen Psaki and fellow MSNBC talking heads Joy Reid and Rachel Maddow chuckled in March upon learning from a Super Tuesday exit poll that Virginia voters were concerned about the costly, deadly, and destabilizing influx of millions of illegal aliens into the nation.

The exit poll found that immigration was the top concern among 38% of Republican voters. When asked what should be done about the illegal aliens in the U.S., 61% of Republican respondents in Virginia said to send them packing to wherever they came from.

For the well-paid Biden boosters, this was evidently a laughing matter.

"Well, Virginia does have a border with West Virginia. Very contested area," quipped Maddow.

The reality of the Biden administration's failure to secure the border has, however, once again adversely impacted the very Americans whose concerns the MSNBC panelists thought laughable.

The Campbell County Sheriff's Office arrested an illegal alien Wednesday and charged him with the rape of a minor.

The sheriff's office indicated that Hiuder Pedro Javier Sacul-Caal, previously arrested in Virginia for drunk driving, is in the country illegally and has been deported at least once in the past, reported WSET-TV.

"Due to the fact that this is an active investigation, the sheriff's office will not be releasing any additional details related to the case," said Sheriff White Clark in a statement.

"We are especially sensitive to the fact that these crimes involve a young juvenile who lives here within our community," continued Clark. "Like any criminal investigation conducted by the Campbell County Sheriff's Office, upholding the integrity of a case is priority for our department and the Campbell County Commonwealth's Attorney."

Sacul-Caal is being held without bond at the Blue Ridge Regional Jail.

Sacul-Caal is hardly the first illegal alien to appear on the radar of Virginia law enforcement officials in recent months.

The Campbell County Sheriff's Office arrested Renzo Mendoza Montes, a 32-year-old illegal alien from Venezuela, in February in connection to the rape of a 14-year-old girl the previous month. Montes was charged with one felony county of carnal knowledge of a child without force and one felony charge of taking indecent liberties with a minor, reported WDBJ-TV.

Montes stole into the country in September 2023. He was detained then released by U.S. Customs and Border Patrol in El Paso.

In March, illegal alien Isauro Garcia Cruz was arrested in Virginia for the statutory rape of a 15-year-old girl who was found in a forest the previous month. He was ultimately sentenced to one year in prison.

Chief Assistant Commonwealth's Attorney Chris Dolen told WSET that Cruz also faces the following charges in Ohio: felony kidnapping; unlawful sexual conduct with a minor; gross sexual imposition; and interference with custody.

David Antonio Calderon, a 46-year-old illegal alien from El Salvador, allegedly murdered a 32-year-old Charles Town woman, torched her body, then assaulted three men in Jefferson County. He was arrested on May 8 in Frederick County, Virginia, reported the Spirit of Jefferson.

Illegals make list of demands for FREE 'culturally appropriate food,' housing, and immigration lawyers



A group of immigrants who have set up camp in Denver, Colorado, have been ordered to vacate their makeshift homes under a bridge and near train tracks — but they’re refusing to budge.

Some of the immigrant encampments also feature Palestinian flags.

While the immigrants have been asked to move to indoor shelters funded by the city, they have instead come up with a list of 13 demands to Mayor Mike Johnston.

“They took the time to break into our country illegally, go all the way to Denver. The least we can do is get them a house to live in,” Pat Gray mocks.

The immigrants reportedly have “had their grievances in the past” regarding the food provided by the city.

“There have been so many complaints about the food being spoiled, or not being enough, and malnutrition amongst children,” immigrant “advocate” V. Reeves tells reporters, adding that “they're not receiving any kind of official housing or immigration document support which is incredibly necessary.”

Included on the list of demands is that the immigrants will cook their own food with fresh, culturally appropriate ingredients provided by the city instead of pre-made meals, and that shower access will be available without time limits and can be accessed whenever.

They also demand regular medical professional visits, referrals/connections for specialty care to be made as needed, and free immigration lawyers per family.

Housing support is to be provided to the immigrants as well as a “clear, just process before exiting someone for any reason.”

All the shelter residents will receive connection to employment support, including work permit applications.

“You can’t make this stuff up,” Gray says, astounded.

Haitian migrant in US legally on Biden's 'parole' program allegedly rapes teen girl



A Haitian migrant residing in Massachusetts has been legally accused of sexually assaulting a teenage girl.

At about 7 p.m. on Wednesday, police received a report of a sexual assault at the Comfort Inn in Rockland, Massachusetts, about 20 miles south of Boston. The hotel is currently being used as a migrant shelter.

When they arrived, they learned that Cory Alvarez, a 26-year-old Haitian national, had allegedly attacked a 15-year-old girl. Both are migrants who have been staying at the shelter, but whether the two know each other is unclear.

"The victim reviewed the photos, pointed at the defendant’s photo, and said that’s the man who raped me," said a prosecutor.

The girl was then taken to an area hospital for treatment.

Alvarez was arrested and charged with one count of aggravated rape of a child with a more than 10-year age gap. He pled not guilty to the charge on Thursday morning. He was denied bond and forced to surrender his passport pending a dangerousness hearing scheduled for next week.

ICE has also reportedly lodged a detainer request for Alvarez, though Massachusetts courts have ignored such requests in the recent past. Last fall, a court in Dorchester released from custody Pierre Lucard Emile, an illegal immigrant from Haiti, even though he had been accused of raping a disabled person. He was arrested by ICE eight weeks later.

Alvarez emigrated from Haiti to the United States last June as part of the Biden administration's "parole" program. Begun in October 2022 and then expanded three months later, the program allows a total of 30,000 migrants from Cuba, Haiti, Nicaragua, and Venezuela to come to the United States legally each month so long as they have a sponsor and can pass "certain checks," Fox News reported. Once here, migrants can remain for two years and even gain work permits.

The Department of Homeland Security claimed that the program provides a "safe and orderly way" for migrants from these countries "to reach the United States" as part of a larger plan to control migration to America from other countries in the Western Hemisphere.

According to reports, Alvarez secured a sponsor in New Jersey and had no prior criminal record before arriving in the U.S.
