DEBATE: Should transgenders be allowed in the military?

To the applause of many on the right, the Pentagon has issued a ban on transgender men and women in the military. Officials have said that as of December, 2024, there were 4,240 troops who were diagnosed with gender dysphoria on active duty — but that number may be higher, as there are about 2.1 million total troops serving.

Defense Secretary Pete Hegseth is among those pleased with the decision, writing, “No More Trans @ DoD" in a post on X.

Democrats are of course fighting the ban — and shockingly, BlazeTV host Alex Stein agrees with them.

“I disagree with this too,” he tells Congresswoman Nancy Mace (R-S.C.). “Because if you look at our military, Congresswoman Mace, and you look at transgenders — I’m just talking about statistically — you want a mean, tough military, right? Nobody’s meaner than a transgender person.”

“Nobody’s more violent than a transgender person,” Mace responds.

“We give them guns, we put them on the front line — the trans out there are like Rambo, and they’re going to fit in,” Stein says.

“But they love Hamas a lot, though,” Mace counters.

“But Hamas will throw them off the roof,” Stein fires back.

“I don’t know that they could shoot a terrorist, because they love them,” Mace says. “They like the terrorists. Look at what they’re doing — Trantifa — in California. Burning it down. I agree with you, but I don’t think they would shoot a terrorist in the Middle East, because they like them so much.”

“That’s a sad, sad, weird, confused person that will go there and protest for Palestinian people that would literally murder them. It’s kind of a weird moral conundrum,” Stein agrees.

“They would decapitate them in a heartbeat. They wouldn’t last five minutes,” Mace adds.

Supreme Court hands Trump major victory on transgender military ban despite liberal dissent

The U.S. Supreme Court issued a temporary victory for the Trump administration on Tuesday on the president's policy of banning transgender members of the military.

The court found that a lower court was likely wrong in its finding against the Trump administration and blocking the ban on transgender members. The one-page order from SCOTUS said that the three liberal justices dissented against the majority.

The lawsuit claimed that the ban violated the 14th Amendment, which guarantees equal protection of the law for all persons.

Neither the majority nor the dissent provided their reasoning for their opinions.

The ruling is not a final opinion on the issue but allows the administration to implement the ban as litigation continues.

The president had issued a ban on transgender members of the military in his previous term as well, but former President Joe Biden had rescinded that order when he won office. The ban depends on a report from the Pentagon that found transgender members were a threat to "military effectiveness and lethality."

The seven plaintiffs in the lawsuit against the ban include current members of the military as well as aspiring members who identify as transgender.

Lambda Legal and Human Rights Campaign Foundation, which represent the plaintiffs, issued a joint statement decrying the ruling.

"Today’s Supreme Court ruling is a devastating blow to transgender service members who have demonstrated their capabilities and commitment to our nation’s defense," the statement read.

They added that the lawsuit "has nothing to do with military readiness and everything to do with prejudice."

The lawsuit claimed that the ban violated the 14th Amendment, which guarantees equal protection of the law for all persons.

Attorneys also accused the administration of claiming transgender people do not exist.

"An unprecedented degree of animus towards transgender people animates and permeates the ban: it is based on the shocking proposition that transgender people do not exist," lawyers wrote.

The ban has also been blocked by a judge in Washington, D.C., but that has been appealed and is being considered by the U.S. Court of Appeals for the District of Columbia Circuit.

‘Judicial Coup’ Threatens To Kneecap Trump’s America First Agenda

Transgender military members sue Trump, Hegseth over trans ban

Several transgender members of the military are suing the Trump administration over a ban on transgender service members.

The federal lawsuit was filed by two LGBTQ+ activist organizations on behalf of six active transgender service members and two others who wish to enlist. They argued that the transgender ban violates the Equal Protection Clause of the Constitution.

'It slams the door on qualified patriots who meet every standard and want nothing more than to serve their country.'

“This ban betrays fundamental American values of equal opportunity and judging people on their merit,” said Jennifer Levi, the transgender and queer rights senior director for GLBTQ Legal Advocates & Defenders.

“It slams the door on qualified patriots who meet every standard and want nothing more than to serve their country, simply to appease a political agenda," she added. "That’s not just un-American; it makes our country weaker by pushing away talented service members who put their lives on the line every day for our nation.”

The National Center for Lesbian Rights also filed the suit.

President Donald Trump ordered the ban on transgender military members on Monday. He first issued the ban in his previous term, but it was rescinded by an order from former President Joe Biden in 2021.

Trump said the executive order would allow the U.S. military to "protect the American people and our homeland as the world’s most lethal and effective fighting force." The order says the military must update medical policies related to transgender members within 60 days.

The lawsuit claimed that the ban order is unconstitutional and discriminates against transgender people.

"Rather than being based on any legitimate governmental purpose, the ban reflects animosity toward transgender people because of their transgender status," the lawsuit read.

Trump and recently confirmed Secretary of Defense Pete Hegseth were named as defendants in the lawsuit.

A report from the Rand Corp. estimated that there were between 2,150 and 10,790 transgender military members.
