Far-left DA punishes prosecutor for 'deadnaming,' misgendering convicted child molester accused of murder



Far-left Los Angeles County District Attorney George Gascón has suspended a prosecutor for "deadnaming" and "misgendering" a transgender person accused of murder.

Prosecutor Shea Sanna is accused of referring to Hannah Tubbs, the infamous convicted child molester, by Tubbs' birth name — James Tubbs — and the male pronouns that refer to Tubbs' biological sex, Fox News reported. In the progressive world, these sins are known as "deadnaming" and "misgendering."

The exact nature of Sanna's punishment, including how many days he has been suspended, is not clear.

According to Fox News, Sanna once served as the lead prosecutor in the Tubbs case. But he transgressed when he "argued in the past that jailhouse phone calls show Tubbs was attempting to use gender identity to game the justice system – an argument that sources say made others in Gascon's office uncomfortable and led to the suspension," according to Fox News.

In response, Sanna said that "deadnaming" and "misgendering" Tubbs is simply a pretext for retaliation. That is because Sanna has been an outspoken critic of Gascón.

"I was suspended for speaking out against the Gascón Administration," Sanna said. "Misgendering Tubbs while informing them that they were being played is just their excuse for the suspension."

Tubbs made national headlines last year after being sentenced to a juvenile facility for sexually assaulting a 10-year-old girl in 2014. Tubbs was 26 years old at the time of sentencing.

Despite not being a minor, Tubbs was sentenced to a juvenile facility because Gascón, at the time, had a policy that prevented "children" from being criminally tried as adults. Gascón had also refused to move the case to the adult court system.

The case blew up after explosive jailhouse recordings revealed Tubbs had been gloating about the light sentence. The leniency later fell through when prosecutors in neighboring Kern County filed charges against Tubbs for a 2019 murder.

Gascón initially claimed he was unaware of the jailhouse tapes. But Sanna publicly disputed that.

"George Gascón was in possession of all evidence and knew or should have known of every statement made by Tubbs when he said he still believes Tubbs should be tried as a juvenile," Sanna told the New York Post last February. "Gascón knew about all 250 plus jailhouse tapes and removed me from the case the night before the hearing where I was going to play the tapes."

Gascón later opened an internal investigation in Sanna.

Hannah Tubbs — the transgender California child molester sentenced to just two years in prison under progressive Los Angeles County District Attorney George Gascón — now faces a potential life sentence in prison for his alleged brutal murder of another man in 2019.

Kern County Judge Brian McNamara found that prosecutors had presented enough evidence and ordered Tubbs, 26, to stand trial on a first-degree murder charge this week for his alleged role in the death of Michael Clark, KGET-TV reported.

During court testimony on Monday, sheriff's investigators said multiple witnesses told them that the defendant, formerly James Tubbs, admitted to beating Clark with a rock before dumping him in the Kern River in April 2019. One investigator even said Tubbs himself admitted his involvement.

"[He] made a comment that it was an accident," Sgt. Mark Chambless said, according to the outlet. "[He] said something to the effect that 'it had gone too far.'"

Both Tubbs and Clark were allegedly part of a "transient survivalist group," or a cohort of homeless vagrants who had decided to move from Spokane, Washington, to Lake Isabella in California. Tubbs was considered the second in command and acted as the group's enforcer, making sure everyone stayed in line.

It was Tubbs' "enforcer" personality that often led to him becoming angry, blacking out, and doing things he doesn't remember, Kern County District Attorney investigator Donald Krueger testified, based on conversations with the suspect. Krueger added that Tubbs claimed he had another personality, as well, called the "transgender side."

Investigators relayed several other versions of the story while on the witness stand. One included Tubbs and Clark being accompanied by another member of the group, Josef Buffaloe. In this version, Buffaloe was the one who choked Clark until he passed out, after which Tubbs wrapped the body in a blanket and threw it in the river.

In another version, Tubbs claimed that Clark and another individual who had been camping in the area, named Chad Mizer, went for a walk and only Mizer returned.

Clark's decomposed body was found in the Kern River in August 2019. A medical examination concluded he died as a result of drowning.

Defense attorney Kate Lee used the multiple conflicting testimonies between witnesses, which she said amounted to 18 different stories, to argue the case against her client should not result in a conviction.

"I think the whole case is such a mess I don’t think the people can get a conviction on this," Lee reportedly said, noting that any member of the group could be a suspect.

The case has risen to the national spotlight due to the defendant's recent child molestation conviction. Tubbs was sentenced to just two years in juvenile detention for violently molesting a 10-year-old girl in the bathroom of a Denny's restaurant in 2014.

Tubbs was just shy of his 18th birthday when he committed the heinous crime, and so, per far-left DA Gascón's policies, he was tried and sentenced as a juvenile despite widespread outcry. The lenient sentence was even criticized by the sentencing judge and the prosecutor who tried the case.

"Very rarely is Tubbs in compliance with anything," lead prosecutor Shea Sanna previously told Fox News. "And now we have an extremely violent, dangerous, unremorseful child predator on the verge of being released, and my boss does not care."

The Los Angeles County district attorney's office said in a statement that officials were not aware of the murder allegations against Tubbs when the sentencing was handed down.

"We were unaware of the murder allegations against Ms. Tubbs until today," the statement said. "As a result, we were never given the opportunity to consider this critical information before proceeding with our case in Los Angeles County. The murder in Kern County took place before our case was adjudicated."

In a statement, the Los Angeles County District attorney's office said officials were not aware of the murder allegations against Tubbs earlier this year.

"We were unaware of the murder allegations against Ms. Tubbs until today," the statement said. "As a result, we were never given the opportunity to consider this critical information before proceeding with our case in Los Angeles County. The murder in Kern County took place before our case was adjudicated."

KTLA reported that Tubbs is being held in a men's jail.

After outcry over the Tubbs case, Gascón amended his controversial policy that awarded Tubbs a lenient sentence.

Now, juvenile offenders in Los Angeles County may be transferred to the adult court system "in the most egregious cases that warrant a state prison commitment."

Because of the heinousness of his crime, prosecutors, politicians, and community members alike desired that he be charged as an adult when he was finally convicted years later. But due to liberal Los Angeles District Attorney George Gascón's hard-and-fast rule against trying juveniles as adults, Tubbs avoided a just sentence.

In the end, the sentencing judge's hands were tied, and he assigned Tubbs just two years in a juvenile detention facility. With good behavior, he could be out in six months, and amazingly, he is not required to register as a sex offender.

While going over the lenient punishment with his shocked father in November jailhouse phone calls, Tubbs appeared to gloat about the slap on the wrist he was receiving.

"I’m gonna plead out to it, plead guilty," Tubbs said in one recording, according to Fox News. "They’re gonna stick me on probation, and it’s gonna be dropped, it’s gonna be done, I won’t have to register, won’t have to do nothing."

"You won’t have to register?" his father asked on the other line.

"I won’t have to do none of that," Tubbs replied.

"So what are they going to do to you then?" his father then pressed.

Tubbs reportedly answered, "Nothing," then laughed.

In another phone call, Tubbs directs the caller on the other line to address him as a female. According to prosecutors, Tubbs did not begin identifying as a female until after he was taken into custody.

"So now they're going to put me with other trannies that have seen their cases like mine or with one tranny like me that has a case like mine," Tubbs is heard saying. "So when you come to court, make sure you address me as her."

In a statement to Fox News, Tubbs' victim in the case decried her attacker's sentencing as "unfair" and "insulting," adding, "The things he did to me and made me do that day was beyond horrible for a ten-year-old girl to have to go through."

"I want him tried as an adult for the crimes he committed against me," she said.

Gascón has been widely criticized for implementing and maintaining such a rule that would allow a dangerous offender like Tubbs to avoid harsher penalties.

Tubbs has been arrested as an adult for battery, drug possession, and probation violations in Idaho and Washington since 2014.

The district attorney has since changed his tune on the case and other ones like it, admitting that two years "may not" be enough in certain cases.

"Like every responsible office, we learn as we go, take feedback from the community, and make necessary adjustments based on our experiences and the complex nature of this work," he said. "Specifically, we learned a lot from the Hannah Tubbs case about the need for a policy safety valve."

"After her sentencing in our case, I became aware of extremely troubling statements she made about her case, the resolution of it, and the young girl that she harmed," he added despite the fact that prosecutors were well aware of troubling statements prior to sentencing.

The Times added that the case drew widespread attention at the time; however, Tubbs was not linked to the crime until 2019 when his DNA was obtained following his arrest on a separate battery charge in Idaho. Prosecutors noted that Tubbs did not identify as female until after being taken into custody.

Prosecutors were hoping for a just sentence in the case, but their hope was dashed after it collided with Gascón's hard-and-fast rule against trying juveniles as adults. The progressive prosecutor has argued that scientific studies show the adolescent brain isn’t fully developed until age 25 and thus young offenders should always be given time to rehabilitate.

There is apparently no exception to the district attorney's rule, not even for repeat offenders like Tubbs, who has been arrested as an adult for battery, drug possession, and probation violations in Idaho and Washington. Tubbs also has a pending misdemeanor case in Washington and was accused of sexually assaulting another minor in Kern County, California, though that case was not prosecuted.

"Tubbs is 26 years old. Unlike George Gascon’s false narrative, she is not a ‘kid,'" L.A. Deputy District Attorney Jon Hatami, reportedly told Fox News. "There was evidence presented at the juvenile proceedings which showed that Tubbs sexually assaulted two young girls in different incidents in the past. The child victims will suffer lifelong trauma. Tubbs also has prior violent convictions and conduct as an adult."

"I want to be clear," added Judge Mario Barrera during sentencing. "The filing of a transfer motion is entirely within the discretion of the district attorney."

In a statement Thursday, Kathryn Barger, chair of the Los Angeles County Board of Supervisors, called the outcome of the case "unsatisfactory" and "not just."

In a written statement provided to the judge last week, the victim in the case said she had to undergo therapy because of the sexual assault, which left her feeling worthless, powerless, and sometimes suicidal.

“I just wanted to forget I’m part of any of this,” she said. “And I’m constantly reminded of my past because of this case. I live in fear most of the time, and although it’s something that I tried to tell myself isn’t my fault, I could never truly believe it. I feel that I’m to blame somehow, when I know deep down that isn’t the case. I chose not to come into court because I couldn’t stand the thought of having to see my attacker's face again. And I hope, after all of this comes to an end my attacker gets the punishment he deserves for attacking a child with no problem and I can finally get on with my life.”

Amazingly, Tubbs will not have to register as a sex offender for his crime.
