Jan. 6 Committee subpoenas Rudy Giuliani, among others, demands phone records from Eric Trump and Kimberly Guilfoyle



The Jan. 6 Committee issued subpoenas for Rudy Giuliani, Sidney Powell, and two others on Tuesday in addition to demanding phone records from Eric Trump and Kimberly Guilfoyle.

The latest actions by the committee are the latest in a series of subpoenas intended to aid their investigation into the rioting at the U.S. Capitol on Jan. 6, 2021. Critics of the committee accuse Democrats of abusing the powers of the government to damage former President Donald Trump and his allies.

CNN reported that subpoenas had been issued for phone records from Trump's son and the former Fox News host who is now engaged to be married to Trump's other son, Donald Trump Jr.

"We're piecing together information from the President's inner circle and others who were in a position to see and hear what the plot was leading up to the riot," said committee member Rep. Zoe Lofgren (D-Calif.) on Monday to CNN.

CNN said a source "familiar with Eric Trump's thinking" about the subpoena told them, "He's not losing any sleep over it."

An attorney for Guilfoyle told CNN that she was not yet aware of any subpoena for her phone records, but he added that any such action would be "of no consequence to her because she has absolutely nothing to hide or be concerned about."

The committee also subpoenaed four attorneys related to the pro-Trump effort to invalidate the official results of the presidential election, including Rudy Giuliani, Sidney Powell, Boris Epshteyn, and Jenna Ellis.

“The four individuals we’ve subpoenaed today advanced unsupported theories about election fraud, pushed efforts to overturn the election results, or were in direct contact with the former President about attempts to stop the counting of electoral votes," said Committee Chairman Rep. Bennie Thompson, (D-Miss.).

Other targets of the committee have denied their subpoenas by claiming executive privilege or asserting their Fifth Amendment right against self-incrimination.

Michael Flynn sues to block Jan. 6 Committee from obtaining his phone records



Michael Flynn filed a lawsuit Tuesday to block the congressional committee investigating the Jan. 6 rioting from obtaining his phone records via subpoena.

The former national security advisor for the Trump administration was scheduled for a deposition with the committee earlier in December, but postponed it as he "engaged" with officials about the validity of the subpoenas.

"General Flynn did not organize, speak at, or actively participate in any rallies or protests in Washington, D.C., on January 6, 2021, and he of course did not participate in the attack on the Capitol that day," the lawsuit read.

The lawsuit sought an injunction against House Speaker Nancy Pelosi (D-Calif.) in order to give the court a chance to determine the "legality" of the subpoenas.

Flynn is only the latest of several former Trump aides and staffers to file lawsuits against the subpoenas issued by the select congressional committee. Former Trump campaign aide Steve Bannon also defied the subpoena and argued that he had protection under executive privilege.

The Democrat-controlled House of Representatives disagreed and voted to refer Bannon to the Department of Justice for criminal contempt of Congress. He was later indicted by a grand jury and he voluntarily turned himself in to law enforcement authorities.

Later, the Jan. 6 Committee voted to refer Mark Meadows, the former chief of staff in the Trump administration, for criminal contempt after he refused a subpoena by pleading his Fifth Amendment right against self-incrimination.

In a video interview Tuesday, Flynn referred to the rioting at the U.S. Capitol as the "insurrection crucifixion."

Flynn had been granted a full pardon by then-President Trump in Nov. 2021 over charges that he had lied to the FBI while being questioned during the Russian collusion investigation.
