DOJ sues Denver over its ongoing war against the 2nd Amendment — and local Democrats aren't pleased



Denver has for decades impinged upon the Second Amendment rights of its residents.

Since 1989, the city has had a so-called "assault weapons" law on the books that now prohibits the carriage, storage, possession, manufacture, and sale of "any semiautomatic pistol or centerfire rifle, either of which have a fixed or detachable magazine with a capacity of more than fifteen rounds" and "any semiautomatic shotgun with a folding stock or a magazine capacity of more than six rounds."

'The Constitution is not a suggestion.'

According to Denver's Code of Ordinances, the city council that initially advanced the ban determined that the use of "assault weapons poses a threat to the health, safety and security of all citizens" in the city and that restrictions on law-abiding Americans' access to such firearms were both "reasonable and necessary."

The Trump Justice Department demanded in a letter last week that the city repeal the ban, underscoring that it is unconstitutional. Assistant Attorney General Harmeet Dhillon of the DOJ's Civil Rights Division said that failure to comply would likely trigger a lawsuit.

On Monday, the city's attorney, Miko Brown, wrote back to Dhillon, calling the request "baseless, irresponsible, and a clear overreach of the federal government's power."

Democrat Denver Mayor Mike Johnston chimed in, characterizing the DOJ's effort to restore Denverites' rights as intimidation and claiming that the ban "has stood for 37 years because it works, it saves lives, and it reflects the values of our community."

Democrat Councilwoman Serena Gonzales-Gutierrez joined the chorus of fearmongerers, stating both that the Trump administration was trying to deprive students and families of critical "protections" and that "assault weapons take lives — that's what they're made for."

On Tuesday, the DOJ filed a lawsuit with the stated intention of vindicating "the rights of Denver citizens whose rights have been — and are continuing to be — violated."

"The Constitution is not a suggestion and the Second Amendment is not a second-class right," acting Attorney General Todd Blanche said in a statement. "Denver's ban on commonly owned semi-automatic rifles directly violates the right to bear arms."

Citing the standard for applying the Second Amendment outlined in the U.S. Supreme Court's landmark ruling in New York State Rifle & Pistol Association Inc. v. Bruen, the government's complaint asserts that the "Ordinance is presumptively unconstitutional" and that the City of Denver "will not be able to rebut this presumption."

After noting that the Second Amendment protects firearms "typically possessed by law-abiding citizens for lawful purposes that are in 'common use' today" — a protection affirmed by the Supreme Court's decision in District of Columbia v. Heller — the complaint explains that there are at least 28 million AR-style semiautomatic rifles presently in circulation and tens of millions of law-abiding AR-style-rifle owners in the country.

In addition to the numerousness and common use of such weapons, the DOJ's complaint shreds the notion that AR-15-type rifles are the go-to choice for criminals.

When making this point, the DOJ highlighted FBI data showing that whereas there were 364 homicides known to have been committed with rifles of any type in 2019, 6,368 homicides were committed with handguns, 1,476 were committed with knives or other cutting instruments, 600 were committed with hands and feet, and 397 were committed with blunt objects.

Assistant Attorney General Harmeet Dhillon of the DOJ's Civil Rights Division stated, "Law-abiding Americans, regardless of what city or state they reside in, should not have to live under threat of criminal sanction just for exercising their Second Amendment right to possess arms which are owned by tens of millions of their fellow citizens."

Chicago school district lets children ditch class over ICE fears: Report



A school district in a Democratic-led sanctuary city has reportedly implemented an attendance policy that allows illegal immigrant students to skip school due to fears of federal immigration enforcement.

Chicago Public Schools students can be marked as "excused" from class if their parents or guardians express fears about immigration operations, according to a document obtained by Defending Education and reviewed by Fox News Digital.

'CPS should not be turning attendance policy into a sanctuary immigration tool.'

The document, titled "Chicago Public Schools' Attendance Coding for Safety Concerns Related to Federal Representative Activity," states that the district is "fully committed" to providing children a safe learning environment, adding that it "has strong protections and protocols in place to protect our students and staff."

CPS highlighted a November 2024 resolution from the Chicago Board of Education, stating that "while these protections and procedures are related to immigration enforcement, they apply to interactions with all federal agents and representatives, including the National Guard."

The district explains that, as part of its commitment to "Chicago's Welcoming City Ordinance," it does not ask about immigration status and will not cooperate with Immigration and Customs Enforcement agents.

Under a section labeled "Attendance Guidance," the CPS document reads, "If a parent/guardian reports an absence and attributes it to fear of federal representative-related procedures, schools CAN excuse the absence under 'concern for student health and safety.'"

When filling out an excused absence request, parents are instructed not to provide any additional information about the absence other than indicating a "concern for student health and safety" to protect the family's "confidentiality."

The district states that it does not set a time limit for how long this reason for absence may be used.

If a parent or guardian has been "impacted by federal representative-related procedures," they can appoint a short-term guardian who can request an excused absence on behalf of the student.

Students are similarly permitted to arrive late or leave early to "avoid official start and dismissal times wherein federal representatives may be present," the document adds.

Additionally, the district reportedly allows students one excused absence "to engage in a civic event," such as a demonstration or protest.

While the Illinois State Board of Education does not currently permit students to participate in a hybrid or remote option, CPS states that if this policy changes, it will provide updated information.

"Chicago Public Schools is effectively telling families that fear of federal law enforcement is a standing excuse to keep children out of class with no time limit and no paper trail," Kendall Tietz, an investigative reporter at Defending Education, told Fox News Digital. "CPS should not be turning attendance policy into a sanctuary immigration tool. Instead, public schools should be focused on getting kids to school and keeping accurate records, not quietly encouraging truancy and obstructing cooperation with federal authorities. This policy undermines both student learning and the rule of law."

CPS did not respond to a request for comment.

‘Flood the zone’: ICE fires back at Boston Mayor Wu’s sanctuary defiance



President Donald Trump's Immigration and Customs Enforcement is pushing back against Boston Democrat Mayor Michelle Wu's refusal to end the city's sanctuary policies.

During a rally held earlier this week, Wu stated that the city received a letter from the U.S. Attorney General Pam Bondi "threatening to prosecute city officials and withhold federal funds unless we cooperate with carrying out mass deportations."

Bondi sent similar letters to Chicago, Philadelphia, and Washington.

'Our elected officials may not appreciate the important work ICE does, but their residents sure do.'

Wu accused the Trump administration of causing "fear and harm" within the community.

Acting ICE Director Todd Lyons fired back at Wu's refusal to cooperate with immigration officials.

During an interview on "The Howie Carr Show" on Wednesday, Lyons declared, "We're definitely going to … flood the zone, especially in sanctuary jurisdictions."

"Boston and Massachusetts decided to say that they wanted to stay sanctuary," Lyons continued. "Sanctuary does not mean safer streets. It means more criminal aliens out and about the neighborhood. But 100%, you will see a larger ICE presence."

Lyons stated that there are many Boston law enforcement officers and jurisdictions outside the city that want to work with ICE.

"That's what I think local leaders don't understand is they need to talk to the men and women on the ground, because … there are so many of these criminal aliens that keep getting released to go out and commit more crimes that the local law enforcement have to deal with. We can take that violent criminal alien instantly out of the neighborhood," Lyons added.

"Massachusetts residents are safer when ICE is keeping our country safe," Paul Craney with the Massachusetts Fiscal Alliance told Blaze News. "If ICE Director Tom Lyons wants to flood Boston, it just means Boston will become safer. Anyone who has eyes has seen for themselves the crime in Boston, and as a state and city, we should be doing everything we can to welcome their assistance. Our elected officials may not appreciate the important work ICE does, but their residents sure do."

ICE Boston announced Thursday that it recently completed a four-day operation in Connecticut, declaring the state "a sanctuary no more."

Acting Field Office Director Patricia Hyde contended that sanctuary policies endanger the communities they aim to protect.

Hyde told “America’s Newsroom” on Wednesday, “Unlike Mayor Wu, I was born and raised in Massachusetts. I grew up in Boston.” Wu was born and raised in Chicago. She first moved to Massachusetts to attend Harvard

"I know what a safe Boston looks like, and this isn’t it,” Hyde remarked.

Socialist Mamdani promises to 'Trump-proof' New York City, expel ICE



As evidenced by President Donald Trump calling Rep. Jasmine Crockett "the future of the Democrat Party" on Friday morning, Democrats have been at a loss for direction since Trump's inauguration. However, New York's self-proclaimed socialist mayoral candidate, Zohran Mamdani, has recently been making waves in the largest city in America.

Mamdani launched what he called the "Five Boroughs Against Trump" rally tour on Monday, speaking at locations in each borough throughout the week. He finished the tour of the boroughs on his home turf in Queens on Friday.

From messages of "hope" and affordable living to attempts to connect Andrew Cuomo with Trump, one issue stood out among all others: immigration. Born and raised in Uganda until age 7, when his family moved to America, Mamdani made clear that he would do everything in his power to protect New York City's "sanctuary city" status and resist Trump's immigration policies.

Friday morning in Queens, Mamdani took a final jab at the Trump administration in a message of defiance: "Today marks the fifth and final day in our Five Boroughs tour of this city, and standing up against the Trump administration's vision and the way in which it mandates an attack on the very fabric of the city that we call home," Mamdani told the crowd at the 32BJ Service Employees International Union in Richmond Hill.

In Staten Island on Wednesday, Mamdani took aim at Trump's enforcement of immigration law: "As we gather on an island, where nearly 1 in 4 were born outside of this country, an island where 30% of its residents speak a language other than English, it's an island that we know is not immune from this horrific crackdown."

Mamdani's platform website lays out a plan for "Trump-proofing NYC": "He'll ensure our immigrant New Yorkers are protected by strengthening our sanctuary city apparatus: getting ICE out of all City facilities and ending any cooperation, increasing legal support, and protecting all personal data."

"Comrade Mamdani is the American people's worst nightmare," White House spokeswoman Abigail Jackson told Fox News earlier this week. "The American people have repeatedly rejected the communist agenda, and the more Mamdani shares his radical policies, the more the American people will recoil."

Mamdani's campaign and the White House did not respond to Blaze News' request for comment.
